1. Acceptance of Terms

By accessing or using Market Arc ("the Service"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you must not use the Service. We reserve the right to update these terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

Market Arc is a price tracking service that monitors retail product prices across supported online stores. The Service notifies registered users by email when tracked product prices change. Features available to you depend on your subscription plan (Free, Pro, or Business).

3. Important Limitations

• Price accuracy: Prices displayed are obtained through automated scraping and may not always reflect the exact price shown on a retailer's website. Market Arc does not guarantee the accuracy, completeness, or timeliness of any price data.
• Product variants: Prices may vary depending on product size, colour, or other variant options. The price tracked may correspond to a specific variant and not necessarily the one you intend to purchase.
• Price delays: There may be a delay between a price change occurring on a retailer's website and Market Arc detecting and reporting that change. Price alerts are checked periodically, not in real time.

4. Subscriptions and Payments

• Free plan: Market Arc offers a free tier that allows tracking of up to 3 products. No payment information is required to use the free plan.
• Paid plans: Pro and Business plans are billed monthly via Stripe. By subscribing, you authorise recurring monthly charges to your chosen payment method.
• Cancellation: You may cancel your subscription at any time from your account settings or by contacting support. Cancellation takes effect at the end of the current billing period — you retain access to paid features until then.
• 14-day cooling off: Under the Consumer Contracts Regulations 2013, you have the right to cancel a paid subscription within 14 days of purchase for a full refund. To exercise this right, contact us at support@market-arc.net.
• Price changes: We may adjust subscription pricing with at least 30 days' written notice. Continued use of a paid plan after a price change constitutes acceptance of the new price.

5. Affiliate Links

Some links in Market Arc emails and on the website may be affiliate links. This means we may earn a small commission if you click through and make a purchase, at no additional cost to you. Affiliate relationships do not influence which products are tracked or which price alerts are sent. We clearly disclose affiliate links where they appear.

6. Acceptable Use

You agree not to:

• Use the Service to scrape, harvest, or collect data for purposes unrelated to personal price tracking.
• Attempt to bypass product limits, rate limits, or other restrictions imposed by your plan.
• Share API keys or account credentials with third parties.
• Use the Service in any way that could damage, disable, or impair its operation or interfere with other users.
• Reverse-engineer, decompile, or attempt to extract the source code of the Service.

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

7. Limitation of Liability

To the fullest extent permitted by law, Iulian Albu (the operator of Market Arc) shall not be liable for any loss or damage arising from:

• Purchase decisions made based on price data provided by the Service.
• Inaccuracies, errors, or omissions in tracked prices or alert notifications.
• Service interruptions, downtime, or delays in price checking.

In no event shall total liability exceed the amount of subscription fees you have paid to Market Arc in the 3 months immediately preceding the claim.

8. Governing Law

These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
